The Brazilian Federal Revenue Service (RFB) has established specific guidelines for the taxation and reporting of these assets. Below are the key points every cryptocurrency investor should know to stay compliant and avoid tax penalties:<\/p>\n<ol>\n<li><strong>Capital Gains Tax<\/strong><\/li>\n<\/ol>\n<p>Profits earned from selling cryptocurrencies are treated as capital gains and are subject to income tax. The tax rates vary based on the total gains realized within a month, as follows:<\/p>\n<ul>\n<li>Up to R$5,000.00: <strong>Exempt<\/strong><\/li>\n<li>R$5,000.01 to R$10,000.00: <strong>15%<\/strong><\/li>\n<li>R$10,000.01 to R$30,000.00: <strong>17.5%<\/strong><\/li>\n<li>R$30,000.01 to R$50,000.00: <strong>20%<\/strong><\/li>\n<li>Above R$50,000.01: <strong>22.5%<\/strong><\/li>\n<\/ul>\n<ol start=\"2\">\n<li><strong> Transaction Reporting<\/strong><\/li>\n<\/ol>\n<p>Since August 2019, the RFB requires all cryptocurrency transactions to be reported through the <em>Declara\u00e7\u00e3o de Opera\u00e7\u00f5es com Criptoativos<\/em> (DOCA). This includes not only sales, but also purchases, exchanges (permuta), donations, transfers to and from exchanges, and any other operations involving crypto assets.<\/p>\n<ol start=\"3\">\n<li><strong> Tax Payment<\/strong><\/li>\n<\/ol>\n<p>The tax must be paid by the last business day of the month following the transaction that generated the capital gain. Payment is made via a <em>DARF<\/em> (Federal Revenue Collection Document), using the specific code for capital gains.<\/p>\n<ol start=\"4\">\n<li><strong> Annual Income Tax Return<\/strong><\/li>\n<\/ol>\n<p>In addition to reporting individual transactions, investors must declare their cryptocurrency holdings in the annual income tax return. Crypto assets should be listed under \u201cAssets and Rights\u201d using code <strong>99 \u2013 Other Assets and Rights<\/strong>. The amount declared must reflect the acquisition cost.<\/p>\n<ol start=\"5\">\n<li><strong> Loss Compensation<\/strong><\/li>\n<\/ol>\n<p>Losses from cryptocurrency sales can be offset against future gains from similar operations, reducing the amount of tax due.
